Stern’s Motion to Quash Blogger Subpoenas
Howard K Stern has filed a motion to quash the subpoenas that were served on the husband and wife blogging team of Rose Speaks. This was done in the lawsuit, Virgie Arthur vs Howard K. Stern and CBS Studios and KPRC Houston
Stern bases his motion on Federal Rule of Civil Procedure 26(d) stating that discovery has not yet started in this matter.

I would like to address everyone that comments on this site. In the past week, I have had to ban two people for comments containing character assassination, and this morning there was a threat against another poster. This site welcomes opinions from both sides, but from now on, I am going to have to delete comments and ban people that will not follow the rules.
When in discussion with an opposing view point, please just discuss your opinion and do not call each other names or swear at them or accuse them of anything. I have been guilty of the same on other sites as well but I am not going to argue with people anymore. I’ll just state my case and move on. I know it is hard to do but things seem to be getting out of hand everywhere.
Please help me keep this site a pleasant place to discuss the many facets of the life and death of Anna Nicole. Thank you….QV

If they were compensated in anyway, including promise of future compensation and/or employement by an associated (as in being paid for moderating and site) that is is quid por quo and someone is going to be in trouble.

There were no paid bloggers that I know of on my site but after Rose got her own site, she sent out letters to researchers saying thank you from the “Liaison for Howard K. Sterns legal team”. Also Rose said that I ruined her “attorney work product” status by outing her, but she still kept doing what she was doing.

IMO Wood was used to controlling bloggers during the Ramsey days…things are different now….the web is more active….people are not so easily intimidated and are enjoying expressing their opinions on this case. So Wood’s office hanging out on your site QV is not going to scare away any bloggers/posters. They must be eagerly awaiting the next installment (so are we LOL)

I have always respected QV and this site. I don’t name call. I try to not be antagonizing in any post I make. I do read this blog in case there is something that may show Howard or anyone in a different light, other than speculation and personal opinions. I rely on the actual court documents to make my personal decisions. I believe Howard is completely innocent of murder or even manslaughter. Did he make some mistakes? Yes, we all do. Hell, Ford Shelly himself said, before the fight over the house, “Howard and Anna would never hurt that boy.”
I can assure you that no one involved in RoseSpeaks is a paid blogger. If the hard drives have to be turned over, so be it. That will be proof there is nothing more than people who got together for the same reason, to search the truth through researching court documents, legal papers, etc. It’s not about not turning the hard drives over. It’s about freedom of speech and thought process. Everything posted on RoseSpeaks, other than a few posters who don’t know how to control themselves, is backed up by court documents or inconsistencies in interviews, things like that.
It all started with QV’s site and the belief by everyone involved that the media went crazy, pointing finger without cause, etc… It saddens me that the friendships that were made here have seperated, no matter the reason. We are on different ends of the spectrum now and each of us stand strong by our beliefs. Doesn’t mean that any of us are bad people. Doesn’t mean that we have to call each other names. There are some that are a little off their rocker and will stop at nothing to try and hurt someone with words but how can a person sitting on the other side of a computer screen, whom you have no personal connection to and truthfully don’t even really know if what they say about themselves is true, hurt you? They can’t me. I don’t let what they say rule me. It doesn’t affect me in my daily life so it’s no biggie. I wish more people could let go of the hate or bashing thrown their way. Maybe that way things would have been different in the blogging world. Who knows? Then again, you will always have those that stop at nothing.

Maybe I should have read the motion first. This is about “implied” personal jurisdicition and nothing else. By serving this subpeona, if accepted and acted on, it implies that HKS accepts personal jurisdiciton in Texas.

I betg to differ, Uh oh. It STARTED when a 20 year old boy died in his mother’s hospital room from an overdose of methadone. I do believe Howard is responsible for the methadone getting from point A to point B. I became more convinced by the exposure of the Death pictures especially after seeing that disgusting clown video….and he thinks he can make us swallow his spin? Howard destroyed himself ALL BY himself, and the wheels of justice are turning tighter and tighter. I thank goodness for sites like this that are not afraid of some overbearing attorney with misplaced delusions of grandeur. I can’t wait for the HKS vs O’Quinn, but you can bet Lin will want to settle….he doesn’t dare take it to court. I can’t wait for VA vs HKS, but you can bet Lin will offer to settle….he doesn’t dare take that to court. Howard can’t afford for 12 logical, intelligent people to hear the truth, in my opinion. To any DOJ or DEA people who may be reading this site for fun…I say, offer immunity to Dr. E and she will sing like a canary.

have notof one person, saying Howard ordered pills of any kind in his name. i have seen The articles on Anna’s personnal computer, where she ordered her drugs, and p[ut the names of anyone she wanted, on them.She had done that, before she met Howard., and she would mix her own cocktails. she also would take more than the dosage, specified. Who carried her “BAG” when she was with Ben Thompson? Who mixed her cocktails then?? ANYONE who knew Anna, and was around her, knew she did every thing in excess. Vergie also knows that.

Anna was one lazy gal. She loved it when people waited on her and carried her bags and pups. Howard tried to convince Kapoor to prescribe the drugs Dr. E had requested. Kapoor knew better. Howard testified that he controlled the drugs to keep Anna from overmedicatied. He controlled her to death…proof was found blue and lifeless on a bed at the HRH. Howard who rarely came unglued from Anna chose that day to go check out the boat Anna bought, but that has somehow ended up in the name of Crackers, a corporation where there are only 2 shareholders, one of them being Howards Bahama attorney, Wayne Munroe….wonder how that little name change came about. Howard, who helped Dr. E. stick a very sick Anna in a tub of ice water rather than take her to a hospital where she could be helped. Howard, who tells conflicting stories of his movements on that day. Howard, who lied about the drugs in his name, under oath, no less. Howard, who, if you can believe him, and I don’t, admits he had a relationship with his client that was unethical, and therefore was kept secret. Howard, who lied about being the father of Dannielynn after Ben Thompson refused to….and there is another story that has not become publicly known as yet, which I think Howard uses to keep certain other interested parties from telling the truth. Of course, this is my opinion, but it’s a very strong opinion.

Carole, to sort of continue on with you thoughts, why would anyone necessarily believe that only Anna had access to her computer? So WHAT if the meds were ordered on her personal computer? Anyone who entered that house, or certainly anyone who lived there, could have used that computer at any given time. I’ll bet almost every person here has, at some time, used someone elses computer or let someone use theirs.
If we could read her emails we would most certainly know if she did the ordering. I can’t see Anna successfully spelling names of medications, can anyone else?

Okay, now I’m confused. Didn’t Stern attend a Deposition on this case in Texas? Isn’t a Deposition considered “discovery”. If so, then how can he argue that discovery hasn’t started yet when discovery already already happened? And, just for sake of argument, let’s say that the Deposition was only on Jurisdictional matters. Aren’t these subpoena’s also addressing the jurisdictional matter? So what is Stern/Wood afraid of?

here’s my take - that Stern objection isn’t going anywhere because one of the purposes of deposing Rose is to show that HKS had dealings with Texas (Rose) for the purpose of showing jurisdiction. Wilma was allowed to be deposed for “jurisdictional purposes only” - ok Wood didn’t bother to depose her for one hour in the judge’s chambers but nonetheless a deposition for jurisdictional purposes was allowed and Wilma was a “third party” as is Rose. So the same thing will be allowed here. Mc Cabe is no dummy, much as some would like to think. This is just my analysis of the whole thing - I may not be right.

Hey Karma, HKS was deposed RE HKS vs O’Q….these are concerning VA vs HKS…he was deposed in Atlanta January 4 regarding jurisdiction and failed to bring requested documents, claiming the bankruptcy court had them. I’m sure they would have given him copies if he had requested them. I will go one better and say he has copies anyway, IMO

Thanks Anony Mouse (cute nic btw) and Carole. So many lawsuits involving the same people, I get confused sometimes.
Anyway, the way Ms. Mouse explained it, that sounds pretty clear that the objection will be noted but not allowed. McCabe is an excellent attorney, so I will look forward to reading his response to the objection.
And if we behave and play nice, maybe QV will link us to those documents when available. I also want to thank her for being on top of these new documents.

Today on the television that you obviously believe when its against Vergie, they said that Howard did not even bother to follow the strecher out to the ambulance. He had phone calls to make but paramedics were still working on Anna. He must not have needed to know that part.
Vergie does not want to raise Dannielynn. She just wants to make sure she is safe. And what do you know about what goes on behind closed doors at the Birkhead house right next door to Doctor Kris?
Truth is that none of us know anything. The actual players know. But we don’t. So why don’t you relax and wait for the real facts come out in court before you pass judgement.

Marking the first anniversary of Anna Nicole Smith’s death on Friday is a new book by two confidants - and her baby-daddy, Larry Birkhead, tells me he plans to sue.
“Anna Nicole: Portrait of an Icon” is a controversial look at her topsy-turvy life. Written by her dress designer Pol’ Atteu and his partner Patrik Simpson, the book tells some startling stories from their eight years of friendship.
Most damaging for Birkhead could be the couple’s account of meeting him at Camp Kindle, a retreat for HIV-positive youth.
“After our first meeting with Larry Birkhead he gave us the impression he was ‘family,’ displaying some unusual behavior by hitting on Pol’ and myself,” alleges Simpson. The book also claims that Birkhead’s “secret rendezvous there included spending quite a bit of time with a particular young and handsome male counselor.”
Birkhead told me yesterday: “They are absolutely crazy, their stories are false, and they will be sued.”
Separately, Atteu recalls being summoned to the Bahamas with an outfit for Anna Nicole to bury her son, Daniel - only to be told she needed a wedding dress to marry Howard K. Stern instead.
“We were completely dumbfounded and confused. There was no mention of Daniel’s funeral,” Atteu writes. He made the wedding dress with fabric he’d brought for baby Dannielynn’s nursery curtains.
In her final weeks, the book says, Smith went from denial that her son had died to a conviction that he was calling to her and that she had to go to him.
Atteu and Simpson are releasing the title through Corona Books, an imprint owned by former “Hollywood Super Madam,” Jody (Babydol) Gibson. Although the book is not yet in stores, it is available for download.

The site was started by QV for her own reasons. Everyone came here originally, or most people anyway, because of the crazy state the media was in. We wanted a place to work together and find the truth. The media was in a frenzy and throwing accusations left and right.
You wear you heart on your sleave. Nothing wrong with that but I can see that it would be pointless to debate or even try to “show” my point with you because of it. Nothing wrong with that either but I’m not going to get into a “it started with the death of a 20yr. old boy” type discussion. I believe Daniels death was completely accidental. IMO that is what the evidence shows. Your opinion is different. That’s all. I didn’t post what I did to get hit with the “Howard is a bad guy” thing. I just don’t believe it to be true. Made mistakes. Yes. Didn’t know how to handle Anna’s drug use other than enable her. Yes. Bad guy for it. No. If you’ve never watched the show Intervention then I encourage you to. It shows families enabling drug users everyday until they get to that point, whatever that point may be. Drug addiction is a disease just as bipolar, etc.. You probably are aware of that already. It’s not a moral disease. It’s an emotional one and it sucks everyone around that person into it and eats them up.
I hold no ill will against you because you believe differently than I do. It’s you right and I absolutely will not “fight” because of it. I would hope you would afford me the same courtesy.

That would be true but UNTIL the jurisdicitonal side is resolved then what McCabe is asking for can’t be turned over. There has been no connection with HKS and RoseSpeaks. Bonnie knows it exists and through “osmosis” I’m pretty sure Howard knows it exists but, Rose has never spoken to, been given orders by, etc.. HKS. She has never been given any orders by Bonnie either, as she says and I believe her. Minimal contact with someone doesn’t automatically imply guilt. I’ve had minimal contact with Bonnie through myspace. QV has had minimal contact with Bonnie and so have several others. I have never spoken with Bonnie about anything involving the case other than to say “tell HKS to keep his chin up.” I have never had any kind of orders related to RoseSpeaks and that is the honest to God’s truth.
Wilma was deposed concering the Florida case. She is a direct connection with Don Clark and Rita Cosby. She worked for Don Clark and Rita named him as the source for the alleged sex tape.
I don’t know if that makes sense. I hope it does.

Larry has said he is going to testify in March when the inquest resumes. How about we wait until then to pass judgement on Larry not testifying? If it turns out he doesn’t then I will have something to hold against him but right now, I see him as a young man who absolutely adores his daughter. I don’t think anyone can say she isn’t being well taken care of and loved. Larry is acting like any other young, single man. Becoming a parent does mean your life changes but it doesn’t mean you have to become a hermit. I’m a parent. I go out every once in a while and drink a little to much. It happens. I don’t see how someone can look at a picture and tell the state of a persons being, unless that person is a Britney Spears (poor girl), Paris Hilton type person. I don’t think a picture of someone dancing proves intoxication. Different opinion but with the utmost respect.

When my final article comes out, there will be excerpts from emails that Bonnie did indeed “give orders”‘ as you say.

Uh oh, I have no beef with you. You have an opinion that I don’t agree with…it happens. I don’t understand your POV just as I’m sure you don’t understand mine. Emotional? for sure I am. I will always believe Howard morally and legally responsible for Daniel’s death and for Anna’s. My decision is not based on anything said by John O’Quinn (angel in disguise) or Virgie Arthur (seeker of justice). I formed my own opinions about the calibur of man Howard is based solely on his actions and proven lies.
If he were innocent in the death of Daniel, he would be on a white house leading the charge to justice with Virgie. As it is, it’s my opinion he’s using his horse to try and malign Virgie, thus drawing attention AWAY from his own involvement.
Yes, he was an enabler, yes he allowed Dr. E to write scripts in his name, because no pharmacy would fill anymore in Anna’s name or in any of her alias’s…..I’m sure records will show she was scripted to the point no pharmacy wanted to be responsible for her health anymore. Howard could have gotten her to a hospital for treatment…..(look at Britney’s intervention). But then he would have lost his control of her. She would have gotten clean, and told him once more to Get Out of Her Life.
It is my strong belief Howard is responsible for the deaths of two individuals, and that he is lying about being broke.

Actully you can have a fever of a 106′ and live. Last June my mother was rushed to the hospital with 107′ her body was almost in shock. She just turned 76 in January and was married in November so see she didnt die.

Mish, your mom is a very fortunate woman. Any doctor will tell you, in adults any fever over 104 should be taken very, very seriously. 105 degree fevers are known to cause convulsions.

A temperature that high can, and often does, cause brain damage. IF Larry had a temp that high, he’s lucky to be feeling so well this soon.

So tell us if what you say is true about Daniel’s death being an accident, why didn’t Howard learn his lesson about enabling?? Why wouldn’t he have been more concerned for Anna and the prescription drugs she was taking?
You see, for most people that would have been a big ol’ wake up call.

What are the treatments for the condition?
If possible, treatment is usually directed first at whatever is causing the fever. Most bacterial infections, for instance, are treated with antibiotics. Most common viral infections, on the other hand, cannot be treated except to relieve symptoms. If the cause is known, it makes sense to reduce the person’s discomfort by bringing a moderate fever down. Acetaminophen (i.e., Tylenol) or ibuprofen (i.e., Advil, Motrin) are useful for this purpose. Because a fever may return after the first dose of medication, doses should be taken as directed throughout the day. Extra fluids should be taken to help avoid dehydration. For a very high fever, bringing the temperature down is an immediate priority regardless of the cause, in order to prevent brain damage. Sponging or bathing in lukewarm water can reduce body temperature by cooling the skin. Ice water or alcohol sponge baths are no more effective than lukewarm water, so these should never be used. Extra clothing and blankets should not be used because they will only cause the fever to rise. Fevers greater than 106 degrees F are very serious and must be treated in the hospital.

QV, just wanted to thank you so much for such a wonderfully informative site. I’m sorry for all the drama that you’ve had to endure. I am very impressed with the research and work that you and yours have done. Looks like I’ve got 3 new books to buy. Of the last 3, Rita’s was my favorite. The other two, wrote about her from a jaded/judging angle. I am still dying to read Moe’s book, I wonder what ever happened to that, it had a release date with Target for last year…….then it NEVER came out…………hmmmmmmmmmm

Vergie tried to get Anna clean ,”she says”, Larry tried to stop Anna , when she was pregnant, He was booted. NO ONE but Anna could get Anna clean,she had od a number of times, before,She and Daniel would be alive today, had she opted to stay in CA. and face Larry, and the law suits. Anna with the help of Ben Thompson and Ford Shelley, put this whole event in motion, Howard was not around. Ben was helping her defraud Larry. and Larry was supposed to be his friend. lets put the blame where it belongs.
